"The Origin of Superboy" is the first Superboy story.

Superman co-creator Jerry Siegel had twice submitted Superboy pitches to DC. The first, in 1938, was deferred for future consideration. DC apparently did not respond to the second, which was submitted in 1940. The concept as published differed somewhat from Siegel's pitch. The central idea of Superman as a boy was common to both. However, Siegel had proposed a slapstick-humor feature with no costume for the character. What DC published was a costumed-character adventure strip.

The feature became a source of contention between Siegel and DC. Siegel did not learn of the strip until after it began publication, and DC did not offer payments until he complained. Siegel refused DC's offer, which was the same as what he was paid for Superman stories he did not script. Siegel and Superman co-creator Joe Shuster included the dispute as a cause of action in a 1947 lawsuit to regain ownership of the Superman property. In 1948, the New York State Supreme Court found that DC had misappropriated Siegel’s Superboy concept. The court found in favor of DC and the other defendants with the other causes of action in the complaint. Ownership of Superboy was transferred to DC in a settlement later that year.
